This chapter counts two kinds of loss: personal liberty and money. Conduct people sometimes dismiss as harmless can lead to detention, fines, or criminal punishment. Each entry gives the amounts or sentencing ranges in the cited law and, where available, cases published through official channels. All laws, institutions, and RMB amounts concern China. The Public Security Administration Punishments Law cited here is the 2025 revision, effective 1 January 2026, whose article numbers differ from the old law. The consolidated Criminal Law text is the version through Amendment XI reposted by Beijing’s traffic-management bureau; relevant amendments are identified below. Do not forward unverified emergency reports or fabricate incident images

Knowingly forwarding a fabricated emergency report can fall under the same rule as making it up. Administrative penalties can include five to ten days’ detention and a possible fine up to RMB 1,000. Serious disruption of social order can bring up to three years, or three to seven years for serious consequences. Fabricated images, including AI-generated “scene photographs,” can count as creating false information.

Avoid insulting legally protected heroes, martyrs, and national symbols in posts or group chats

Chinese law attaches administrative and, in serious cases, criminal penalties to specified insults against protected heroes, martyrs, and national symbols. A person posting two insulting messages about Yuan Longping in a 499-member village WeChat group received six months of public surveillance, a noncustodial criminal sentence restricting liberty. A group chat is not necessarily private for legal purposes.

Understand the legal risks of redistributing overseas content, and do not possess unlawful extremist material

The cited Chinese national-security provisions concern specified incitement, dissemination, funding, or provision of information, not simply every act of reading an overseas page. Reposts and comments can become evidence of dissemination where the offense’s elements are met. Incitement to subvert state power or split the country carries up to five years for the basic offense, and at least five years for leaders or major offenders. Knowingly and unlawfully possessing materials promoting terrorism or extremism is a separate offense in serious circumstances, even without redistribution.

Do not distribute pornographic material in groups, sell access, or run distribution groups

The cited Chinese provisions target distribution and related conduct; they do not create a general penalty for privately viewing adult material. Sending a file to a group distributes it to the group. Administrative detention can reach ten to 15 days, with a possible fine up to RMB 5,000, and serious distribution can carry up to two years. Distribution for profit can carry much heavier sentences. A group mainly used for distributing obscene electronic material can meet criminal criteria at 30 members under the cited interpretation.

Reject “part-time work” using your own account to receive, withdraw, or transfer other people’s money

A small fee can expose you to criminal liability or administrative penalties. In one official case, a person brought ID and one bank card to a designated location, helped transfer and withdraw money, and earned just over RMB 500. Prosecutors did not charge him, but police still imposed ten days’ administrative detention and a RMB 1,000 fine. Another participant received two years and three months plus a RMB 22,000 fine.

Do not lend your identity to a “packaged” loan application or take a share for signing

Falsifying a borrower’s circumstances and taking a cut can lead to loan-fraud charges. One 126-person operation presented unemployed people as high-quality borrowers and obtained over RMB 30 million from more than 80 bank branches. The front borrowers received 30% of the loan amount. Of 80 people sentenced at first instance in the cited 2026 report, 76 received one year and four months to six years and six months. The person named and signing as borrower can also remain responsible for the debt.

Return found phones and wallets, and never withdraw money with a found bank card

Keeping another person’s property and refusing to return it can become criminal misappropriation when the conditions and value threshold are met. Using a found bank card at an ATM is more serious: it can be treated as fraudulent use of someone else’s credit card, with up to five years and a RMB 20,000–200,000 fine at the basic level. That offense does not require the owner to bring a private prosecution.

Use promotions honestly; do not manufacture new users or false transactions to collect rewards

Using your genuine identity and an eligible account to claim an offered benefit is different from fabricating users or transactions. Fraudulent claims can cross criminal thresholds, which provinces set within the national ranges. In one case, delivery riders bought virtual numbers for RMB 0.1 each and generated false new-user claims; one obtained over RMB 90,000, and all 12 defendants were convicted.

Never throw anything from a window or balcony

Throwing something from a height can attract penalties even if it misses everyone, provided the legal danger condition is met. Serious injury or death can lead to much heavier charges than the standalone throwing-from-height offense. One person received ten years after bottles and glasses thrown from a 21st floor seriously injured a 13-year-old; another received a death sentence approved in 2024 after bricks thrown from a 32nd floor killed someone.

Do not buy uncertain “toy guns,” BB guns, or airguns online

Under the cited Chinese identification standard, a nonstandard gun unable to fire conventional ammunition can still be classified as a firearm if its muzzle specific kinetic energy reaches 1.8 joules per square centimeter. Unlawful possession can carry up to three years, or three to seven in serious cases. In one official “toy gun” case, 18 of 43 seized items met the firearm standard; non-prosecution depended on insufficient proof that the sellers knew their nature.

Register your drone, check the airspace, and do not bypass flight restrictions

Flying without required registration can bring a fine up to RMB 200, or RMB 2,000–20,000 for serious circumstances. Unauthorized flight in controlled airspace can lead to a fine, confiscation, or administrative detention. In one case, a person paid to bypass the altitude limit, flew to nearly 3,000 meters, and posted cloud footage; the result was five days’ detention.

Voyeurism, covert filming, eavesdropping, and disclosure of private matters can bring detention or fines. Unlawful use of specialized covert-recording equipment causing serious consequences can carry up to two years. Two people who installed equipment in rooms at three hotels received one year and three months and one year respectively. Ordinary lawful home security is different from covertly recording another person’s private room.

The legal risk changes when you profit from facilitating gambling, gamble with a sufficiently large stake, organize gambling, or make a living from it. Administrative penalties include detention and fines; criminal gambling can carry up to three years, while opening a casino carries up to five years at the basic level. There is no single national amount defining a “large” gambling stake for the administrative rule.

Avoid wild game and do not buy or keep protected wildlife without a lawful basis

Eating or buying nationally protected wildlife for food can lead to confiscation and a fine of two to 20 times its value. Illegal purchase, transport, or sale of protected rare or endangered wildlife can be criminal. Obstructing lawful official duties can bring a warning, fine, or detention. Violently attacking police lawfully performing their duties is a separate criminal offense. Biting, slapping, kicking, throwing, or hurling objects that cause the specified injury or other legally relevant consequences can meet its conditions. More dangerous attacks can carry three to seven years. Ordinary resistance is not automatically the same as a violent police assault, but do not assume it is consequence-free.

The cited Chinese provision treats intercourse with a girl under 14 as rape and requires heavier punishment, regardless of apparent agreement, with a basic statutory range of three to ten years before aggravating circumstances. The cited court explanation treats a child under 12 as someone whose age should have been known. For ages 12–13, indications from development, speech, behavior, or clothing can establish knowledge. Claims of genuine ignorance are scrutinized strictly.

Before striking someone, consider detention, compensation, and a possible criminal sentence

An assault can bring five to ten days’ detention and RMB 500–1,000, with criminal penalties if injuries meet the legal threshold. Compensation is separate. In official examples, a defendant who broke three ribs paid RMB 113,000 and reached a settlement before receiving a non-prosecution decision; another who fractured a radius and did not compensate received ten months’ imprisonment.

If you cannot raise a child, seek a lawful civil-affairs process; do not sell or abandon the child

There is a lawful route when eligible parents cannot raise a child: contact civil affairs directly about assistance and a legally permitted adoption. An adoption relationship begins with registration. Privately handing a child over for money may amount to child trafficking, with a basic sentence starting at five years. Abandoning a child or refusing a support duty in grave circumstances can carry up to five years.

Do not invent an insured accident or inflate a claim; knowing helpers can share criminal liability

Fabricating an accident or exaggerating losses to obtain insurance money can be insurance fraud. At the basic criminal level, the sentence is up to five years plus a RMB 10,000–100,000 fine. A person knowingly supplying false testimony, assessment, or valuation to make the fraud possible can be an accomplice. In the cited Anhui case, eight people received two to four years and RMB 10,000 fines each.

Do not sell an organ or recruit donors for a broker

Chinese law prohibits organ trading. Living donation is restricted to the donor’s spouse, direct blood relatives, or collateral blood relatives within three generations under the cited regulation. In a Beijing case, sellers received only RMB 20,000–25,000 for a kidney while recipients were charged RMB 180,000–220,000. Illegal proceeds can be confiscated and fines reach ten to 20 times the transaction amount. The health consequences are separate and potentially lasting; see living with one kidney.

Buying sex in China can mean detention, not simply a fine

The ordinary administrative range for prostitution or purchasing sex is ten to 15 days’ detention, with a possible additional fine up to RMB 5,000. Only lesser circumstances fall into the up-to-five-days-or-up-to-RMB-1,000 category. Knowingly engaging in prostitution or purchasing sex while having a specified serious sexually transmitted infection can also be criminal, carrying up to five years.
