One 126-person operation presented unemployed people as high-quality borrowers and obtained over RMB 30 million from more than 80 bank branches. The front borrowers received 30% of the loan amount. The person named and signing as borrower can also remain responsible for the debt.

Obtaining loans, bill acceptances, letters of credit, guarantees, or similar bank credit through deception and causing major loss can carry up to three years and a fine or a fine alone. Especially major loss or other especially serious circumstances brings three to seven years and a fine. The cited prosecution threshold for that offense is direct economic loss of at least RMB 500,000. Loan fraud with intent to unlawfully possess funds is a different offense, involving such methods as invented funding projects, sham contracts, false certificates, or false property documents. Its cited filing threshold is RMB 50,000, with a basic sentence up to five years and a RMB 20,000–200,000 fine; huge amounts or serious circumstances bring five to ten years, and especially huge amounts at least ten years or life. Forging, altering, or trading state-agency documents, certificates, or seals carries up to three years, or three to ten years for serious circumstances. The official operation involved 126 people across 16 provinces and municipalities, over 80 bank branches, and more than RMB 30 million. Prosecutors pursued 105 front borrowers with otherwise usable credit profiles, who received 30% of the borrowed sum. Among 80 first-instance judgments reported in 2026, 76 defendants were convicted of loan fraud and sentenced to one year and four months through six years and six months, with fines. Four who also withdrew money for the group were convicted of both loan fraud and money laundering, with combined sentences of two years and four months through seven years and six months. The deceptive-credit provision cited reflects Amendment XI, effective March 2021.

Context & considerations

The claim “I intended to repay” was rejected in the reported case based on lack of work, fixed assets, or repayment capacity and spending of the participants’ shares. Cash withdrawals can add money-laundering liability. Even where no crime is established, the debt and credit record can remain with the signatory borrower. Leaving China does not settle it: evasion after a case opens does not let the limitation period expire. People serving an unfinished sentence or treated as criminal suspects or defendants may be barred from exit; courts may also restrict exit in unresolved civil or enforcement matters under the applicable rules.
