Buying sex in China can mean detention, not simply a fine
The ordinary administrative range for prostitution or purchasing sex is ten to 15 days’ detention, with a possible additional fine up to RMB 5,000. Only lesser circumstances fall into the up-to-five-days-or-up-to-RMB-1,000 category. Knowingly engaging in prostitution or purchasing sex while having a specified serious sexually transmitted infection can also be criminal, carrying up to five years.

Article 78 of the revised Public Security Administration Punishments Law provides ten to 15 days’ detention and an optional fine up to RMB 5,000 for prostitution or purchasing sex. Lesser circumstances carry up to five days or a fine up to RMB 1,000. Soliciting in a public place carries up to five days or RMB 1,000. Article 79 applies ten to 15 days and an optional fine up to RMB 5,000 to inducing, sheltering, or introducing others into prostitution; lesser circumstances carry up to five days or RMB 1,000–2,000. Article 87 provides ten to 15 days’ detention for personnel in hotels, food services, entertainment, taxis, and similar businesses who warn participants about a police operation or otherwise facilitate the specified conduct. Criminal Law Article 360 punishes knowingly engaging in prostitution or purchasing sex while suffering from syphilis, gonorrhea, or another specified serious sexually transmitted infection with up to five years, criminal detention, or public surveillance, and a fine. The revised administrative law took effect on 1 January 2026.
Context & considerations
Administrative detention means confinement in a detention facility, not simply paying and leaving. Arranging participants or providing premises can fall under Article 79, while hotel or karaoke staff warning customers about police action can fall under Article 87. The former separate offense involving a girl under 14 was removed in 2015; the conduct is addressed as rape with heavier punishment. See the child-protection rule. Labels such as “home wellness” or “massage” do not decide the legal classification; the actual conduct does.
