Article 8 of the Disability Employment Regulations sets a minimum disability employment proportion of 1.5% of staff, with the provincial government specifying the local proportion. Article 9 requires the employment security levy where the proportion is not met. Article 8 of the 2015 levy measures gives the formula: annual levy = (previous-year staff count × local required proportion − previous-year qualifying disabled employees) × previous-year average annual employee wage. Article 16 of that dated text exempts newly registered small or micro enterprises with no more than 20 employees for the first three years where the quota is not met. Article 36 of the Law on the Protection of Persons with Disabilities provides lawful tax preferences for employers meeting or exceeding quotas or employing disabled workers in concentrated arrangements. The employment regulations took effect May 1, 2007.

Context & considerations

The source notes that the old three-year, 20-worker exemption would remove this particular incentive for covered firms, but exemptions and levy reductions have changed over time; use the current finance ministry and local rules rather than treating the 2015 threshold as current everywhere.
