If you discover a scam, immediately call 110 or 96110 about stopping the payment

The time just after a transfer is the best opportunity for police to stop payment or freeze funds, with banks required to cooperate. Once the money has been moved through several accounts and dispersed, recovery becomes much harder. Call first instead of investigating or confronting the scammer yourself. China’s 96110 number is used for police anti-fraud warnings; take genuine warning calls seriously.

Distrust unsolicited instructions, protect your information, avoid unfamiliar links, and verify transfers

Pause and verify before following any instruction involving money or account access. Common patterns include paid “order tasks,” fake investments, fraudulent loans, fake customer service, police or court impersonation, romance-investment scams, and sexual lures linked to paid tasks. They typically move toward asking you to send money first. Recognizing them early is cheaper than trying to recover funds later.

Voluntary surrender can reduce a baseline sentence by up to 40%, with greater reductions or exemption possible for minor offenses. Truthful confession after being found can also bring mitigation. These are discretionary legal factors, not guaranteed discounts. Once a case has been opened, evading investigation or trial does not let you run out the prosecution time limit.

Never rent, lend, or sell your bank card, SIM, or payment account for someone else’s transactions

Renting, lending, or selling covered accounts or SIMs can itself breach China’s anti-fraud law. Illegal gains may be confiscated, with fines and potentially administrative detention, credit consequences, or restricted account functions. Knowingly helping online crime through payment transfers can constitute the crime of assisting information-network criminal activity, carrying up to three years. Money-mule work is not an ordinary part-time job.

You may stop an ongoing unlawful attack, but stop when the attack ends

Necessary defense against an ongoing unlawful attack on you or someone else can be lawful even if the attacker is injured. Chinese law gives broader protection against specified violent crimes seriously endangering personal safety. The action must target the attacker and stop when the threat genuinely ends. A favorable final decision does not guarantee you will avoid investigation or initial detention.

For unpaid wages, dismissal, or financial harm, use complaints and legal proceedings instead of revenge

Legal proceedings may fail to recover money. Retaliatory violence can leave the money unrecovered and destroy your own life as well. In the Wuxi campus case, a man angry about not receiving a diploma and about internship pay killed eight people and injured 17; he was sentenced to death and executed. Wage-enforcement channels, by contrast, recovered RMB 8.65 billion for 654,000 workers in 2024.

Treat thoughts of killing someone along with yourself as an emergency: leave, hand over dangerous items, and call 12356

The interval between an impulse and action can be short. In interviews with 82 suicide-attempt survivors, 47.6% reported no more than ten minutes from the first thought to the attempt. The immediate task is to create distance from vehicles, knives, gas controls, ropes, and other means, and get through the crisis with another person’s help. Leave the conflict, hand over keys or dangerous objects safely, and contact China’s psychological-support line, 12356.

Take threats against family seriously and seek an urgent professional assessment

Statements such as “none of you will get away with this” or “I will take the children with me” can signal danger. For a suspected mental disorder accompanied by harm or a credible risk of harm, close relatives can arrange an urgent hospital assessment; the hospital must not refuse assessment. Involuntary admission requires the legal clinical criteria, including a diagnosis of serious mental disorder and danger to others. If uncertain, contact 12356 for guidance or call 110 for an immediate police response. Hiding credible danger does not help the person.

Document loans clearly and guarantee a debt only if you could accept repaying it yourself

A complete written loan record makes a later claim easier. Before guaranteeing someone’s debt, check whether it is an ordinary guarantee or a joint-and-several guarantee. With an ordinary guarantee, the creditor generally pursues the borrower and enforcement first. With joint-and-several liability, the creditor can demand payment directly from you under the guarantee.

Track limitation periods: usually three years for civil claims and one year for labor arbitration

The general civil limitation period is three years from when you knew or should have known of the infringement and the responsible person. A court does not raise it on its own, but a valid limitation defense from the other side can defeat an otherwise enforceable claim. A properly evidenced demand can interrupt the period and start it again. Labor arbitration uses a different one-year framework.

In litigation and enforcement, report assets truthfully instead of transferring them to relatives or companies

Moving a home into a company or sending money to relatives to defeat enforcement is not a loophole. Serious refusal to enforce a judgment when able to do so can bring up to three years, or three to seven years in especially serious cases. Knowing helpers can be accomplices, and assets can still be recovered. Refusing or falsifying an asset report can bring an individual fine up to RMB 100,000 or up to 15 days’ detention. Genuine inability to pay is different.

Distinguish spending restrictions from a judgment-defaulter listing, and challenge errors through the court

A high-consumption restriction and a judgment-defaulter listing are different measures. The listing rules specify six grounds, with time limits and removal conditions. Qualifying removal must occur within three working days. Spending restrictions cover specified nonessential or high-cost activities; necessary living or business expenses can be submitted for court approval. Check the version of the rules currently in force.

For online-shopping or secondhand fraud, complain to the platform, report it, then assess a civil claim

Start with the platform’s deposit and enforcement mechanisms, then report suspected fraud. China’s locally set criminal threshold for ordinary fraud falls within a RMB 3,000–10,000 range, so RMB 3,000 is not a universal national threshold. Conduct below the criminal threshold may still receive administrative penalties. A qualifying online-purchase dispute can be brought where the goods were received, and eligible small claims have a two-month target and no ordinary appeal.

Keep clear transfer records for betrothal gifts and other marriage-related payments

Chinese law prohibits using marriage to extract property and supports return where that rule is breached. Other grounds for returning betrothal gifts include no marriage registration, registration without actually living together, or qualifying hardship caused by pre-marriage payment. Registered couples who have lived together ordinarily do not receive a full automatic return. Whoever pays should preserve evidence, regardless of sex.

Put premarital-property arrangements, added ownership names, and parental contributions in writing

Premarital property does not automatically become joint property because a marriage lasts many years. Spouses can make a written agreement about separate and joint property. A promise to give a home or share to the other spouse can have very different consequences before and after registration. Hiding, transferring, squandering, or fabricating debts against marital assets at divorce can reduce or eliminate the offending spouse’s share.

Do not agree to be a company’s nominal legal representative or lend your identity for incorporation

China’s Company Law treats the legal representative as a director or manager who actually conducts company affairs. A nominal title is not automatic immunity. The company may initially pay for harm caused in the representative’s duties and then seek recovery from a representative who was at fault. If you already hold the role, the law provides a resignation route and requires the company to designate a replacement within 30 days.

Do not carry unknown items across a border or accept suspicious packages for someone else

China’s consular authorities advise travelers not to carry another person’s luggage or goods, especially prohibited items or contents they do not understand. If contraband is found, a claim that you did not know can still leave you facing an investigation and serious legal difficulty. The same practical caution applies to unexplained domestic deliveries, especially arrangements requiring you to advance money for a later refund.

Keep your dog leashed; animal-injury liability does not depend simply on proving your fault

If your animal injures someone, you generally owe compensation even without proof that you personally acted negligently. Proof of the injured person’s intent or gross negligence can sometimes reduce or remove liability. If you breached safety-management rules, such as failing to leash when required, only the injured person’s intentional conduct remains a statutory ground for reducing liability under that provision. Prohibited dangerous animals receive still stricter treatment.

Stop if the other person cannot consent because they are asleep or severely intoxicated, or may be under 14

Someone who is asleep or too intoxicated to understand and choose cannot give valid consent. Sexual intercourse in those circumstances can constitute rape under the applicable law, with a basic sentencing range of three to ten years in the cited Chinese provision. Do not proceed and later rely on proving consent. After a drinking event, help arrange a safe handover to the person’s trusted friends or family. See the age-related rules for children under 14.

If someone uses intimate images or threats of exposure to demand money, preserve everything and report it

A demand for money backed by threats to expose intimate material or contact your employer may be extortion. Do not keep paying or delete the evidence; contact police. A first payment can lead to further demands. Publishing the material may create additional privacy or other legal liability. A genuine victim’s lawful compensation claim is a different matter.

Report a deliberately fabricated accusation, but distinguish it from an honest mistake

Inventing facts to expose another person to criminal prosecution or a public-security penalty is itself unlawful. Administrative penalties can include up to five days’ detention or a fine, with five to ten days for more serious cases. A serious deliberate false criminal accusation can carry up to three years, or more for serious consequences. A mistaken or unsubstantiated complaint is not automatically malicious.

Insufficient evidence requires acquittal; challenge unlawful evidence and use appeal or retrial procedures

A conviction requires reliable, sufficient evidence tested through lawful procedures and a conclusion beyond reasonable doubt. If that standard is not met, the court must acquit. Confessions obtained through torture and testimony obtained through violence or threats must be excluded. After a judgment becomes final, the party, legal representative, or close relatives may still submit a complaint seeking review.

Check entitlement to state compensation after qualifying detention followed by withdrawal, non-prosecution, or acquittal

Qualifying loss of liberty can be compensated by the day. The cited procuratorate standard from 18 May 2026 is RMB 495.94 a day, about RMB 180,000 for a year, with possible additional emotional-distress compensation for serious consequences. Not every non-prosecution decision qualifies. Minor-offense discretionary non-prosecution, expiry of limitation, lack of criminal responsibility because of age, and deliberately fabricated self-incriminating evidence can fall within exclusions.

Seek compensation through documented channels; do not make payment conditional on your silence

A victim has a legal basis to claim compensation, and a high demand does not automatically become extortion. Nevertheless, a dispute can become a criminal investigation before the legal position is resolved. Guo Li was sentenced to five years for extortion before being acquitted on retrial. Keep a clear record, avoid isolated private negotiations, and do not phrase a demand as “pay me and I will not expose you.”

First enable the platform’s protection settings, use its evidence-capture feature, and report the content. You may then seek a court injunction to stop ongoing harm, bring a private prosecution where appropriate, or report circumstances qualifying for public prosecution. Police assistance with difficult evidence can be requested through the legal process.

Harming someone to collect insurance creates liability, not a payout

Chinese insurance, inheritance, and criminal law all block the idea of buying cover and then harming the insured person. A death-benefit policy generally requires the insured person’s consent and approval of the amount. Intentional harm by the policyholder can eliminate the insurer’s payout obligation; a beneficiary who intentionally harms the insured loses beneficiary rights. Intentionally killing someone also forfeits inheritance rights. Insurance fraud and homicide can be punished together, up to the death penalty.

Get a police-report receipt and a written decision if a criminal case is not opened

A report-acceptance receipt provides a formal record that you reported the matter. If police decide not to open a criminal case on your complaint, request the written non-filing notice. You can apply for reconsideration within seven days of receipt, then higher-level review within seven days of the reconsideration decision. You may also ask the procuratorate to supervise the decision not to investigate.

Do not pay gifts, cash, or cards to investigators or enforcement officials

Paying to “make a case go away” can be a separate crime for the giver as well as the recipient. Basic bribery carries up to three years; serious cases three to ten; and especially serious cases at least ten years or life. Bribing supervision, administrative-enforcement, or judicial personnel is expressly aggravating. Payment extracted from you without obtaining an improper benefit is a distinct statutory exception.

Record a conversation you take part in when a later dispute is foreseeable

A loan, repayment, refund, compensation, or employment conversation can be remembered very differently months later. Under the Chinese civil-evidence rules cited here, a participant’s recording is not excluded merely because the other person was not told in advance. This does not authorize eavesdropping, intrusion into private spaces, covertly recording someone else’s private life, or coercing statements.

Photograph the whole scene, then positions, then damage—and keep the original files

A close-up of a scratch or an object on the ground may not show where it was or what happened. Start with a wide view including the junction or address, vehicles, people, and surroundings; then show their relative positions; then capture damage or injuries. If something must be moved, photograph it first when safe and feasible. Retain originals on the phone, not only copies compressed through messaging apps.

After domestic abuse, seek immediate safety, preserve a police record, and consider a free protection order

International research shows that intimate partners account for over a third of female homicide victims. Among abused women in one study, previous nonfatal strangulation was associated with more than seven times the odds of later homicide. Report violence and seek a personal-safety protection order in China; you do not have to file for divorce first. The court normally rules within 72 hours after accepting the application, or 24 hours in an emergency.
