Seek formal work-injury recognition after workplace injury or a qualifying commuting crash; apply yourself if the employer does not
Workplace injury and qualifying commuting traffic injuries where you are not primarily responsible can count. Recognition is the gateway to medical, paid-recovery and disability benefits. Employers should apply within 30 days; if they do not, the worker, close relatives or union can apply within one year.
What it takes
No application fee described. Submit the form, proof of employment and medical diagnosis to the Chinese social-insurance administrative authority.
What you may gain
Without recognition, claiming medical expenses, paid recovery wages and disability benefits becomes impossible under this route. If the employer misses the 30-day application deadline, it bears qualifying benefit costs arising during that unreported period.
Context & considerations
Treat the one-year deadline as urgent. Preserve incident photographs, coworker contacts, medical and attendance records even where the employer carries a burden of proof. Article 16 excludes intentional crime, intoxication/drug use and self-harm/suicide. Article 15 also treats sudden illness at work during working hours followed by immediate death or unsuccessful rescue within 48 hours as deemed occupational injury.
