Overtime has 150%, 200% and 300% rates; complain to labor inspection if unpaid
Chinese weekday overtime is paid at least 150% of wages; rest-day work without compensatory leave at least 200%; statutory-holiday work at least 300%, without substituting time off. Complain to labor inspection if unpaid. After an official payment deadline is missed, an additional 50%–100% of the sum due can be ordered.
What it takes
Free. Regularly save attendance, rosters, overtime approvals and managers' work assignments in group chats. Remembering every month takes effort.
What you may gain
The cited Labor Law states no more than 8 hours daily and an average 44 hours weekly. Ordinary overtime is generally limited to 1 hour daily, or 3 for special reasons, with 36 hours monthly overall. Extended normal-day hours receive at least 150%, rest-day work without compensatory leave 200%, and statutory holidays 300%. The holiday provision contains no compensatory-leave alternative. Labor authorities can order payment by a deadline; continued failure requires additional compensation of 50%–100% of the amount due.
Context & considerations
Distinguish actual statutory holidays from adjacent rearranged rest days: the latter use rest-day rules. An approval requirement or the claim that you stayed voluntarily does not automatically remove entitlement, but can make proof harder; retain assignments and approvals. Comprehensive-calculation and irregular-hours schemes need labor-authority approval, not merely a company announcement. See arbitration limitation periods.
