Once the injury stabilizes, obtain a work-capacity assessment before settling; the disability grade determines payment
After stabilization, China's work-capacity assessment assigns the grade used for benefits. Lump-sum disability benefits equal 18 months' own wages for grade 5, 16 for grade 6, 13 for grade 7, 11 for grade 8, 9 for grade 9 and 7 for grade 10. Do not sign a final settlement before the result.
What it takes
No fee described. Complete the assessment process and allow waiting time.
What you may gain
The lump-sum disability benefit is calculated in months of the worker's own wages: grades 5/6/7 receive 18/16/13 months; grades 8/9/10 receive 11/9/7 months.
Context & considerations
Grades 5/6 retain the employment relationship, with applicable monthly disability allowances. For grades 7–10, contract expiry or worker-initiated termination can also trigger a lump-sum medical subsidy from the fund and disability-employment subsidy from the employer; provinces set amounts. Wait for assessment before agreeing a one-time final settlement.
