Death is not a way to resolve debt: insurance exclusions, estate liabilities, and the need for support all matter

Debt problems need a financial and legal plan while you are alive. In China, life insurance can exclude payment after suicide under the statutory conditions, intentional self-harm is excluded from occupational injury recognition, and lawful debts are generally settled from the estate before inheritance is distributed. Article 44 of China's Insurance Law addresses contracts payable on the insured person's death. It excludes the insured benefit where suicide occurs within two years of contract formation or reinstatement, except where the insured lacked civil capacity at the time. Where the insurer is exempt from the benefit payment under this rule, the policy's cash value is returned according to the contract. The source notes that insured sums can be hundreds of thousands of RMB and therefore rates the financial stakes large; this is a description of the law, not a timetable or a promise of payment outside an exclusion. Article 16(3) of the Work-Related Injury Insurance Regulations excludes intentional self-injury or suicide from occupational injury recognition or equivalent treatment. The three Article 39 occupational death benefits therefore do not follow from such a death: a funeral subsidy equal to six months of the area's previous-year average monthly employee wage, dependent-relative pensions, and a lump sum equal to 20 times the previous year's national urban per-capita disposable income. Civil Code Article 1159 requires legally owed taxes and debts to be settled when dividing an estate. Article 1161 generally limits heirs' repayment responsibility to the actual value inherited; people disclaiming inheritance do not assume that inheritance-based repayment obligation.
